During the course of his employment, our client was injured while he was a passenger in a work vehicle. The injury was latent however, and did not become symptomatic until months after the initial trauma.
We filed a claim for workers’ compensation benefits, which was ultimately accepted, supplying our client with disability benefits and medical expenses, including but not limited to two surgeries. We filed a third party claim against the owner of the vehicle that hit the work vehicle, and received the policy limits on behalf of our client. We also successfully filed an underinsurance claim with the work vehicle’s motor vehicle policy.
A lump sum payment is anticipated pending workers’ compensation claims and additional knee surgery.
