Our office represented a landlord who intended to sell his property to his tenant who was in possession of the property with an option to buy. However, the sale could not be consummated because the tenant failed to secure funding. We filed a Complaint for Summary Process and a Complaint to forfeit the deposit pursuant to the terms of the Purchase and Sales Agreement.
During the course of the trial, the court ordered both parties to participate in mediation, which resulted in the settlement of both matters. The tenant was ultimately physically evicted pursuant to a court order; and the house was sold to another purchaser.
